By accessing or using MentupAI ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

MentupAI is an AI-powered learning platform that provides personalized educational content, adaptive learning paths, and interactive tutoring services. The App uses artificial intelligence to customize learning experiences based on individual user needs and progress.

Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account

Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Use the App to generate harmful, misleading, or inappropriate content
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems (bots, scrapers) without permission
• Share your account credentials with others
• Circumvent any access or usage limitations

Our Content

The App and its content, including but not limited to text, graphics, logos, icons, images, audio, video, software, and AI-generated content, are owned by MentupAI or its licensors and are protected by intellectual property laws.

Your Content

You retain ownership of any content you submit to the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing and improving our services.

AI-Generated Content

Content generated by our AI is provided for educational purposes. While we strive for accuracy, AI-generated content may contain errors. You should verify important information from authoritative sources.

Some features of the App may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Automatic renewal unless cancelled before the renewal date
• No refunds for partial subscription periods, except as required by law

Subscription management and cancellation can be done through your Apple App Store account settings.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Results from using the App will be accurate or reliable
• The quality of the App will meet your expectations
• Any errors will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MENTUPAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless MentupAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the App

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MentupAI operates, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
